1. Acceptance of these Terms
These Terms of Use (“Terms”) govern your use of NestShield Cam: Smart Link (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
2. What the App does
The App provides tools for discovering devices on a local network, connecting to compatible cameras, viewing camera streams, creating camera-placement plans, measuring network performance, and saving screenshots or recordings locally. Features may depend on your camera, network, device, iOS version, and granted permissions.
3. No App account
The App does not offer App account registration, App sign-in, social-media sign-in, user profiles, public posting, or messaging. There is therefore no App account to close or disable. You can stop using the App at any time and delete it from your device.
4. Limited license
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store usage rules. The App is licensed, not sold.
5. Authorized cameras and networks only
You may scan, connect to, view, configure, or record only networks and cameras that you own or are expressly authorized to access. You are responsible for obtaining any consent required from property owners, occupants, employees, visitors, or other people who may be recorded.
You must comply with applicable privacy, surveillance, audio-recording, data protection, and property laws. The App must not be used for covert, unlawful, harassing, discriminatory, or rights-infringing monitoring.
6. Camera credentials and security
Any user name or password entered in the App is used to connect directly to a camera or other device you selected. Camera credentials are stored locally in the iOS Keychain and are not App user credentials. You are responsible for using strong, unique camera passwords and for securing your iPhone or iPad, local network, router, and connected cameras.
7. Streams, recordings, and plans
You retain responsibility for camera streams, screenshots, recordings, imported floor plans, room labels, and placement plans that you access or create. You represent that you have the necessary rights and permissions to use this material. Protect exported media appropriately, especially if it contains identifiable people, private spaces, or sensitive information.
8. Prohibited conduct
You agree not to:
- access or attempt to access a camera, device, stream, credential, or network without authorization;
- use the App to violate another person’s privacy, intellectual-property rights, or other legal rights;
- circumvent security controls, distribute malware, disrupt networks or devices, or use scan results to facilitate an attack;
- reverse engineer, modify, redistribute, rent, lease, sublicense, or commercially exploit the App except where applicable law expressly permits it; or
- use the App in violation of applicable law or App Store rules.
9. Third-party cameras and services
Cameras, routers, operating-system services, and other products used with the App are provided by third parties. We do not control them and are not responsible for their availability, security, privacy practices, performance, or terms. Compatibility information is not a guarantee that every feature will work with every device.
10. Updates and availability
We may add, change, or remove App features and may release updates for security, compatibility, or performance. We do not guarantee that the App or any feature will always be available, uninterrupted, or compatible with future versions of iOS or third-party hardware.
11. Intellectual property
The App, including its software, design, text, graphics, and branding, is owned by us or our licensors and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of the App or our marks to you.
12. Disclaimer
To the fullest extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. The App is a convenience tool and is not a substitute for a professionally designed security, life-safety, emergency-response, or surveillance system. Do not rely on the App to prevent loss, injury, intrusion, or other harm.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, recordings, access, profits, or goodwill arising from your use of or inability to use the App. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.
14. Changes to these Terms
We may update these Terms to reflect changes to the App or legal requirements. Revised Terms will be posted on this page with a new effective date. Your continued use of the App after revised Terms take effect means you accept them.
